Defense attorneys in the Samourai and Tornado Cash case accuse prosecutors of withholding potentially exculpatory evidence

The lawyers in the Samourai Wallet and Tornado Cash case have accused prosecutors of concealing a phone call they believe could be crucial to their defense. During the call, a senior staff member from the Financial Crimes Enforcement Network (FinCEN) suggested to government prosecutors that non-custodial protocols might not qualify as a money services business, which is a key element in certain charges. Prosecutors in the Samourai case downplayed these allegations, stating that the call was fairly disclosed before the trial and represented the staff member's "informal personal opinion." Previously, it was reported that the request to dismiss charges against the Bitcoin privacy wallet Samourai Wallet developers was denied, and the case remains in a legal deadlock.
