EU releases crypto asset classification consultation guidance document to help companies comply with MiCA
The European Banking Authority (EBA), the European Insurance and Occupational Pensions Authority (EIOPA), and the European Securities and Markets Authority (ESMA) have released a consultation guide that allows relevant market participants to classify cryptocurrencies and digital assets under MiCA, including determining whether a token is subject to MiCA regulation based on issue prompts such as who the issuer is, whether it is based on blockchain, and whether it is a financial instrument.
